Prediction markets have experienced significant growth following the 2024 presidential election, during which platforms such as Kalshi and Polymarket demonstrated greater accuracy than traditional polling methodologies in forecasting outcomes. The CFTC has claimed exclusive regulatory authority and has challenged state regulatory efforts in at least nine states, including New York, which it sued in April. The CFTC filed an emergency motion late Thursday to prevent New York from applying state gambling laws to Kalshi, characterizing such action as regulatory overreach.
